Anti-Piracy Policy
IRMA Anti-Piracy Compliance ProgramIt is the policy of Raintree not to participate in, or otherwise facilitate, the unauthorized possession, replication, distribution, sale, rental or use of data by its customers.

We want our customers to clearly understand that Raintree cooperates with the various governmental agencies and trade organizations responsible for policing the recording and replication industries. You should be aware that Raintree may provide those agencies and organizations with specific information related to your order.

Raintree voluntarily participates in the International Recording Media Association's Anti-Piracy Compliance Program. Therefore, it is required that all customers, brokers, and/or representatives submit the forms appropriate for each project submitted to Raintree.

In order to comply with IRMA's Anti-Piracy Program, the forms listed at the right are made available for your convenience. Please note that these forms are required, and no order will be processed without them.

Please read each listing to determine if the form is required for your project. You may or may not also be required to submit additional documentation with your project.

Sample Grantor's Letter
In lieu of formal licensing, you can use this form as a guide when your project contains third party intellectual properties. For example, if your project is an audio compilation of selections by numerous artists, you'll need to submit a separate grantor's letter or equivalent for each song.

Copyright Issues for Audio Projects
There are two types of copyright to consider when getting your audio project duplicated or replicated.

The first type is the copyright that covers the rights of authorship and/or publishing of the musical components of a composition such as the music & lyrics. To obtain clearance to reproduce when these rights do not belong to you or your organization, contact the owner(s) of those rights.

If all the rights for all compositions included in your project belong to you or your organization, it is advisable that you make a statement to that effect within your product packaging by using the © symbol.

The second type is the phono copyright. This right belongs to the individual or organization who is the legal owner of the master recording.

In order to reproduce when you or your organization do not own the phono copyrights, you must first obtain a master license from the actual owner.

If all the phono copyrights for all recorded works included in your project belong to you or your organization, it is advisable that you make a statement to that effect within your product packaging by using the Phonocopyright symbol.
You must obtain the proper clearances for any compositional authorship, publishing rights or phono copyrights which do not belong to you or your organization. Raintree will not produce any project when intellectual property rights are not properly documented and/or authorized.

Music Licensing
Raintree supports lawful licensing and consideration for creative works. If you have any doubts about song licensing or publishing rights, we strongly urge you to contact The Harry Fox Agency and/or the National Music Publishers' Association.

It is the right of every songwriter and publisher to be compensated for his or her work, or any use thereof. This includes any audio 'samples' or 'clips' lifted from any source recording and/or broadcast. We respectfully request that our customers support this view and abide by it's intention.

Copyright Issues for Data Projects
For any application, executable file or other data included on your CD-ROM, DVD-ROM or Enhanced CD master of which you or your organization does not own the copyright, trademark, and/or patent, you must provide Raintree with accurate documentation from the owner specifically stating that you or your organization are authorized to reproduce and/or distribute said data.

This includes, but is not limited to, all 'freeware' & 'shareware'. The fact that these items may be freely available for download from the internet is NOT an implication that they are also freely available for you or your organization to reproduce and/or distribute.

Most 'freeware' & 'shareware' data clearances, such as those for Adobe Acrobat Reader,
Microsoft Internet Explorer and Netscape Navigator are relatively easy to obtain. Your first step should be to personally contact each copyright owner.

While this may seem burdensome, it is required, and Raintree will not make any exceptions to this policy. Be advised that we thoroughly check all submitted data masters and compare the contents to the accompanying content disclosure forms and attachments.

Any project on which we can not verify the ownership of any data, or on which documentation is incomplete, will be put on immediate hold until the issue is resolved by you, the customer.
